This Privacy Policy describes how Floqer Inc. ("Floqer," "we," "us," "our") collects, uses, discloses, and protects personal information in connection with the Floqer platform, including our website located at floqer.com, our web and cloud-based application, our application programming interface, our browser extension, our Model Context Protocol server, and any other products, features, or services we offer that link to this Privacy Policy (collectively, the "Service"). This Privacy Policy applies regardless of the device or platform used to access the Service.
If you are an individual whose personal information has been collected, enriched, or processed by the Service on behalf of one of our business customers, please see the section below titled "Information We Process Through Our Enrichment Services" for information specific to your situation.
Information You Provide Directly. When you create an account, contact us, or otherwise interact directly with the Service, we may collect information such as your name, email address, company name, job title, and any other information you choose to provide.
Information We Collect Automatically. When you use the Service, we automatically collect certain information about your device and usage, including your IP address, browser type, operating system, pages viewed, and the dates and times of your visits, through cookies and similar technologies.
Information We Process Through Our Enrichment Services. The core function of the Service is to help our business customers identify, enrich, and organize information about companies and individuals relevant to their sales and marketing activities, drawing on a broad range of third-party and publicly available data sources. In providing this functionality, we collect and process personal information about individuals who are not our direct customers or users, such as employees or representatives of companies our customers are researching or engaging with, on behalf of and at the direction of our business customers. This personal information may include names, business contact details, job titles, employment history, and publicly available professional and business information. We do not collect this information directly from these individuals, and in most cases, they will not have a direct relationship with Floqer. We use the information we collect to provide, maintain, and improve the Service, to communicate with you, to provide customer support, to detect and prevent fraud and abuse, to comply with our legal obligations, and for other purposes disclosed to you at the time of collection or as otherwise described in this Privacy Policy.
The Service uses artificial intelligence and machine learning technologies, including third-party large language model providers, to power features such as data enrichment, workflow automation, and signal detection. We do not use customer data, including personal information processed through the Service, to train the underlying foundation models provided by our third-party AI providers. Where we use AI models to process personal information on a customer's behalf, that processing is performed to deliver the Service to that customer and is subject to the confidentiality and data protection terms in our customer agreements.
We may share information with:
Service providers and subprocessors who perform services on our behalf, such as cloud hosting, data enrichment, analytics, and customer support providers, under contractual terms that restrict their use of the information to providing services to us
Our business customers, in connection with the enrichment, workflow, and signal detection features of the Service
Professional advisors, such as lawyers, auditors, and accountants
Law enforcement or other parties when required by law, or to protect the rights, property, or safety of Floqer, our customers, or others
A successor entity in connection with a merger, acquisition, financing, or sale of assets

Floqer is based in Canada and may process personal information in the United States and other countries. Where we transfer personal information from the European Economic Area, the United Kingdom, or Switzerland to a country that has not been recognized as providing an adequate level of data protection, we rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses, to protect that information. We retain personal information for as long as necessary to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements, after which we will delete or anonymize the information, or, where that is not possible, securely store it and isolate it from further use.
Rights for Individuals in the European Economic Area, United Kingdom, and Switzerland. If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have the right, subject to certain exceptions, to request access to, correction of, deletion of, or restriction on the processing of your personal information, to object to our processing of your personal information, to receive a copy of your personal information in a portable format, and to withdraw consent where processing is based on consent. Our legal bases for processing personal information include your consent, our performance of a contract, our compliance with a legal obligation, and our legitimate interests, such as operating and improving the Service. You also have the right to lodge a complaint with your local data protection supervisory authority.
California Privacy Rights. If you are a California resident, you have the right to know what personal information we have collected about you, to request deletion of your personal information, to correct inaccurate personal information, and to not be discriminated against for exercising these rights, subject to certain exceptions under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the "CCPA"). To the extent any of our data practices constitute a sale or sharing of personal information as those terms are defined under the CCPA, you have the right to opt out by contacting us at privacy@floqer.com.
Other Jurisdictions. Depending on where you live, you may have additional rights under applicable law. To exercise any of the rights described in this section, please contact us at privacy@floqer.com. We will verify your request and respond within the timeframe required by applicable law.
We maintain administrative, technical, and physical safeguards designed to protect personal information, and our security program has been independently assessed against the SOC 2 Type 2 standard. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
The Service is not directed to, and we do not knowingly collect personal information from, individuals under the age of sixteen. If we learn that we have collected personal information from an individual under 16, we will delete that information.
We may update this Privacy Policy from time to time. If we make material changes, we will provide notice through the Service or by other means before the changes take effect. The "Last Updated" date at the top of this Privacy Policy indicates when it was last revised.
